The Massachusetts Joint Committee on Consumer Protection and Professional Licensure Licensure has approved a measure that would prevent automobile insurers in the state from mandating the use of non-OEM part on any vehicle still under manufacturer warranty or lease agreement. Senate Bill 109, filed by Senator Vinnie deMacedo, would replace current language in Chapter 93B of the general laws with the following:
“(k) An insurer shall not dictate the use of a part that compromises the operational safety or structural integrity of the vehicle. No insurer shall mandate non-OEM parts on any vehicle still under manufacturer warranty or lease agreement.”
The bill now moves to the Senate Ways and Means Committee.
